Judge cancels court decision to suspend instant messaging service in Brazil

The suspension of WhatsApp in Brazil has been halted by the court as the judge says it can cause damages to the users

The judges Raimundo Nonato da Costa and José Alencar Ribamar Oliveira, of Piauí Court of Justice (ECJ-PI), on Thursday, February 26 granted injunctions to halt the effects of the decision of the judge Luiz de Moura Correia, Surveys Center the Judiciary in Teresina, suspending the use of WhatsApp application throughout Brazil

The judge of Teresina County of Inquiry Center of Piauí Court of Justice, Luiz Moura Correia, mandated that all telephone companies temporarily suspend the operation of Whatsapp application in Brazil, "to compliance with court order ".

The suspension was determined on the grounds that WhatsApp was refusing since 2013 to pass information requested by the Intelligence Center of Piaui Civil Police, which investigates cases of pedophilia on the Internet.

The magistrate then ordered all telephone operators the application deadlock in Brazil. But companies appealed the extent days later and the judge ruled in favor of companies of the resource.

In an interview with Brazilian website , Alencar explains that one of the reasons justifying the grant of an injunction is the danger of delay, which was applied in the case.

According to Alencar, the suspension of WhatsApp across the country can cause permanent damage to the service and its users.

“The millions of people who use this service can not suffer this loss without a more detailed investigation,” the judge said.

According to Alencar, a decision was made to understand that the extension of the measure applied by the courts would not be ideal.
