The National Agency for Food and Drug Administration and Control (NAFDAC) has filed an appeal against a court judgment which indicted it for failing in its duties to Nigerians.
An Igbosere High Court ordered NAFDAC to pay damages of N2 million after ruling that the agency failed Nigerians by not warning them that consuming Fanta or Sprite with Vitamin C is dangerous.
“Our lawyer has filed an appeal and a motion to stay execution of action of the judgment also filed,” NAFDAC Director General, Yetunde Oni said.
The case was filed by Fijabi Adebo Holdings Limited and Emmanuel Adebo against NAFDAC and the Nigerian Bottling Company (NBC), the manufacturers of Fanta and Sprite.
Adebo had purchased a large quantity of drinks for export to the United Kingdom, but they were found unsuitable for human consumption when tested.
The tests also showed that the drinks became poisonous when combined with Vitamin C.
The court further ordered NAFDAC to compel NBC to place a warning on its Fanta and Sprite products, stating that the contents should not be taken with Vitamin C in order to avoid poisoning.
