A Federal High Court in Abuja has dismissed a lawsuit filed by Philip Shaibu, the impeached Deputy Governor of Edo, seeking to annul the February 22 governorship primary of the Peoples Democratic Party (PDP) in Edo State, which Asue Ighodalo won.
In a recent ruling, Justice James Omotosho clarified that Shaibu lacked the legal standing to challenge the primary's outcome due to his non-participation and absence from the venue on the day it took place.
Justice Omotosho noted that Shaibu's lawsuit was premature, as he did not exhaust the party's internal dispute resolution mechanisms before approaching the court.
The judge stated that, as a PDP member, he was obligated to follow the party's rules, which mandate that any dissatisfied candidate must first appeal to the party's Appeal Committee before taking legal action.
He also determined that ample evidence proved Ighodalo had won the primary.
