"FRSC has the constitutional right to arrest and prosecute traffic offenders"

The Federal Road Safety Commission (FRSC) is announcing it's constitutional right to prosecute traffic offenders.

Law

According to the Federal Road Safety Commission (FRSC), the commission has the constitutional right to prosecute traffic offenders.

Speaking with the News Agency of Nigeria (NAN), Mr Bisi kazeem, the Head of Media Relations and Strategy, revealed that this power comes from the law.

"FRSC has the constitutional right to arrest and prosecute traffic offenders in a Court of Law, while it also has the right to fine such violators. The Right is clearly stated in the Establishment Act of the commission; the FRSC is a law enforcement agency and it is equally a law abiding commission. Road users are, once again, implored to be law abiding so that government efforts to make the roads safer can be more successful."

The law, Section 10(4) of the FRSC Establishment Act 2007, states- "members of the Corps shall have power to arrest and prosecute persons reasonably suspected of having committed any traffic offence”.

The offences stated include obstructing highway with a vehicle or any other object and driving or riding any vehicle on the highway in excess of the prescribed speed.

kazeem claims this right to arrest and persecute has led to the 33% reduction in road crashes.
